The laws surrounding the sale of CBD products from industrial hemp are confusing, to say the least. Many companies claim that these products are “legal in all 50 states”, but this is not really the case. Rather, federal law permits the import of CBD from the “seeds and stalk” of industrial hemp, but some states appear to have laws that prohibit the sales of these products, though enforcement is rare.

The Missouri Attorney General has filed suit against four retailers of CBD from industrial hemp, River City Nutrition in Kirkwood, Planet Health Market in Ellisville,  and Vapur West and Main Smoke & Gift Shop in Kansas City.  The lawsuit follows letters went out earlier this year.  The state passed CBD laws that are very strict, and the AG believes that the retailers are breaking these laws.

The legislature created a process to allow epilepsy patients to purchase CBD oil from licensed nonprofit entities. My office will ensure consumers have access to this treatment without being misled into buying illegal or fraudulent substances.
